SOLAFLEX
RIGHT OF WITHDRAWAL FOR CONSUMERS
If you are a consumer and have concluded a contract with Solaflex GmbH (hereinafter referred to as ‘SOLAFLEX’) by distance selling (e.g. via its website) or outside of business premises, you may withdraw from the contract without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, possession of the goods. This right of withdrawal does not apply if the goods are manufactured according to your customer specifications or are clearly tailored to your needs (e.g. if logos or other advertising materials are printed on the goods; § 18 Abs 1 Z 3 FAGG / 2011/83/EU).
To exercise the right of withdrawal, you must inform Solaflex GmbH (Unteres Tobel 25, A-6840 Götzis, E: info@solaflex.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the template withdrawal form available on the SOLAFLEX website (www.solaflex.com), but it is not obligatory.
If you withdraw from this contract, SOLAFLEX shall reimburse to you all payments received, including the costs of delivery (with the exception of the supplementary costs resulting from the choice of a type of delivery other than the least expensive type of standard delivery offered), without undue delay and in any event no later than 14 days from the day on which SOLAFLEX receives the notification of the withdrawal from this contract. SOLAFLEX will carry out this reimbursement using the same method of payment used for the initial transaction, unless you have expressly agreed otherwise. SOLAFLEX may withhold reimbursement until the goods have been received back or until you have supplied evidence of having sent the goods back, whichever happens first.
You shall return the goods to the address mentioned above or hand them over without undue delay and in any case no later than 14 days from the day on which you have informed SOLAFLEX of the withdrawal from this contract. The deadline is met if you return the goods within the 14 days period. The costs of the return are to be borne by you.
You are only liable to SOLAFLEX for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
If you have ordered a service from SOLAFLEX, you can also withdraw from the contract without giving reasons within 14 days from the day of conclusion of the contract. Unless you expressly request in writing that SOLAFELX should start providing their service within this withdrawal period, SOLAFLEX will only start providing the service after the expiry of this 14-day period. If you have expressed such a request and you still withdraw within the mentioned period, you must pay SOLAFLEX an appropriate amount which, compared to the contractually agreed total price, corresponds proportionately to the services provided by SOLAFLEX up to the time of withdrawal.
